Acceptance of Terms

Welcome to Speak Backwards. These Terms of Service ("Terms") are a legal agreement between you and Benjamin Moran-Perkins ("we," "our," or "us") governing your use of the Speak Backwards mobile application (the "App").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

We may modify these Terms at any time. Changes will be posted in the App. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

Eligibility

The App is available to users of all ages. However, if you are under the age of majority in your jurisdiction, you represent that you have obtained permission from your parent or legal guardian to use the App.

You also represent that:

  • You have the legal capacity to enter into these Terms
  • You are not prohibited from using the App under applicable law
  • You will comply with all applicable laws and regulations

Description of Service

Speak Backwards Speak Backwards is a mobile application that allows users to record audio and play it back in reverse. The app stores recordings locally on the user’s device and provides basic playback and sharing functionality..

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.

User-Generated Content

Your Content

The App allows you to create, upload, and share content including audio. You retain ownership of content you create.

License to Us

By posting content, you grant us a worldwide, non-exclusive, royalty-free license to:

This license exists for the duration that your content is on the App and for a reasonable period thereafter for backup and archival purposes.

Content Responsibilities

You are solely responsible for your content. You represent and warrant that:

  • You own or have the necessary rights to your content
  • Your content does not violate any third-party rights
  • Your content does not violate any applicable laws
  • Your content complies with these Terms

Acceptable Use Policy

You agree not to use the App for any of the following purposes:

We reserve the right to investigate violations of these Terms and take appropriate action, including:

  • Removing violating content
  • Suspending or terminating accounts
  • Reporting illegal activity to law enforcement
  • Taking legal action

We have no obligation to monitor user activity but reserve the right to do so.

Intellectual Property Rights

The App and its content, features, and functionality (excluding user-generated content) are owned by Benjamin Moran-Perkins and are protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the App or its content for commercial purposes without permission
  • Frame or mirror any part of the App

Trademarks

Speak Backwards and associated logos are trademarks of Benjamin Moran-Perkins. You may not use our trademarks without prior written permission.

Disclaimers

"AS IS" and "AS AVAILABLE"

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

  • Merchantability and fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of content
  • Uninterrupted or error-free operation
  • Security or freedom from viruses

No Endorsement

We do not endorse any user-generated content or third-party content. Opinions expressed by users are their own and do not reflect our views.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BENJAMIN MORAN-PERKINS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Damage to or loss of property
  • Personal injury or death (except as caused by our negligence)
  • Damages arising from your use of or inability to use the App
  • Damages arising from third-party content or services

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Termination

Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, for any reason, including:

Dispute Resolution

Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law provisions.

Time Limit for Claims

Any claim must be brought within one (1) year of the event giving rise to the claim, or it is waived.

Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted in the App with a new "Last Updated" date.

Your continued use of the App after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

We encourage you to review these Terms periodically.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Benjamin Moran-Perkins regarding the App.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

Assignment

You may not assign or transfer these Terms or your rights under them without our written consent. We may assign these Terms without restriction.

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.

Electronic Communications

By using the App, you consent to receive electronic communications from us. These communications may include notices, agreements, and other information. You agree that electronic communications satisfy any legal requirement for written communications.

Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.
